1. Acceptance of Terms
By accessing or using RadShiftGuru (the “Service”), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.
2. The Service
RadShiftGuru is a professional networking platform that connects imaging technologists (including CT, MRI, Nuclear Medicine, Ultrasound, Echocardiography, and related modalities) with healthcare employers seeking per-diem, contract, or permanent staff. We provide the platform; we do not employ technologists, place candidates, or act as a staffing agency.
3. Eligibility and Accounts
You must be at least 18 years old and able to form a legally binding contract to use the Service. By creating an account, you represent that the information you provide is accurate and that you will keep it current.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access.
4. Professional Credentials and Verification
Technologists are responsible for the accuracy of their listed credentials, certifications (such as ARRT, ARDMS, NMTCB, CCI), and employment history. Misrepresentation of credentials is a material breach of these Terms and may result in immediate termination.
RadShiftGuru does not independently verify every credential listed on the platform. Employers are responsible for performing their own due diligence, including license verification, background checks, and reference checks, before engaging any technologist.
5. Employer Conduct
Employers using the Service agree to:
- Use technologist contact information solely for legitimate employment inquiries
- Comply with all applicable employment, labor, and non-discrimination laws
- Not engage in unsolicited marketing, spam, or pyramid schemes
- Honor offers and commitments made through the platform
6. Acceptable Use
You agree not to:
- Post false, misleading, defamatory, or unlawful content
- Scrape, harvest, or collect user data through automated means
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to other accounts or to our systems
- Use the Service to transmit malware or other harmful code
- Impersonate any person or entity
7. User Content
You retain ownership of the content you post (profiles, resumes, messages). By posting content, you grant RadShiftGuru a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content for the purpose of operating the Service.
You represent that you have all rights necessary to post the content and that it does not violate the rights of any third party.
8. Privacy
Our Privacy Policy explains how we collect, use, and share information about you. By using the Service, you consent to those practices.
9. No Employment Relationship
RadShiftGuru is a venue. We do not employ technologists, screen candidates beyond basic platform integrity, or guarantee any employment outcome. Any contract, assignment, or employment that results from a connection made on the platform is exclusively between the technologist and the employer.
10. Fees
The Service is currently provided at no cost to technologists and employers. We reserve the right to introduce paid features in the future with reasonable notice.
11. Intellectual Property
The Service, including its design, code, trademarks, and content (other than user content), is owned by RadShiftGuru and protected by intellectual property laws. You may not copy, modify, or create derivative works without our prior written consent.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY USER CONTENT IS ACCURATE OR RELIABLE.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RADSHIFTGURU AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
14. Indemnification
You agree to indemnify and hold harmless RadShiftGuru from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms.
15. Termination
We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. You may delete your account at any time. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property provisions) will continue to apply.
16. Changes to These Terms
We may modify these Terms at any time by posting an updated version. Material changes will be communicated by email or in-product notice. Your continued use of the Service after the effective date of any changes constitutes acceptance.
